Buyer Agreements 101 There has been a lot of talk regarding compensations regarding Real Estate Agents I hope to bring some clarification now and in the continuous future. Buying and selling a home is one of the largest and most important financial decisions you can make. The question is, for buyers, who do you want to represent you? And sellers, who do you want to represent your buyer? The answers to these question are important to both the buyer and the seller. More on this later… For now, let’s get into some latest updates. As of August 17, 2024, sellers have a choice as to whether or not to automatically pay the buyer’s agent’s commission. Our aim is to assist both buyers and sellers in navigating the sale of your home and the buying process. The recent settlement by NAR has brought about various changes that are advantageous for BOTH sellers and buyers. Our aim is to outline these changes clearly now and in the continuous future. Beginning August 17, 2024, a buyer will be required to enter into a written agreement with a real estate agent prior to touring a home. This includes, both in-person and live virtual tours. The buyer agreement must specify how the agent will be compensated, and clearly disclose the amount or rate of compensation the agent will receive, or clearly state how this amount will be determined. Offers of compensation help make homeownership and the benefits of professional representation more accessible to buyers, including first-time homebuyers, increase homeownership opportunities for all, and benefit sellers by expanding the potential buyer pool. You do not need a written agreement if you are just speaking with an agent at an open house or asking them about their services.
